Welcome to ELYSIAN Experiences. These Terms & Conditions govern your use of our website and your participation in our wellness experiences, workshops and events.

By accessing our website, purchasing a ticket or participating in an ELYSIAN experience, you agree to these Terms & Conditions. Please read them carefully before making a booking.

1. About ELYSIAN

ELYSIAN Experiences (“ELYSIAN”, “we”, “us” or “our”) creates wellness experiences designed to help people pause, reconnect and feel good through movement, nutrition, connection and education.

These Terms & Conditions apply to our website, ticket purchases, events, workshops and any other experiences we offer.

If you have any questions, please contact us using the contact details provided on our website.

2. Bookings and Ticket Purchases

All bookings are subject to availability and confirmation of payment.

When purchasing a ticket, you agree to provide accurate and complete information, including any details required to facilitate your attendance.

Your booking is confirmed once payment has been successfully processed and you have received a booking confirmation.

Tickets are valid only for the event, date and time specified at the time of purchase. Unless expressly stated otherwise, tickets may not be resold for commercial gain or used for promotional purposes without our prior written consent.

Please check all event details carefully before completing your purchase.

3. Ticket Cancellations, Refunds and Transfers

We understand that plans can change. Our cancellation and refund policy is outlined below.

Cancellations by participants

Unless otherwise stated in the specific event description or booking conditions, tickets are non-refundable if you are unable to attend or change your mind.

Where permitted and subject to our approval, tickets may be transferred to another person. Please contact us before the event to request a transfer.

Nothing in this policy excludes or limits any rights you may have under applicable New Zealand law, including rights to a remedy where an event or service does not meet applicable legal requirements.

Cancellations or changes by ELYSIAN

We reserve the right to make reasonable changes to event schedules, facilitators, activities, venues or other arrangements where necessary.

If we cancel an event, we will notify registered participants as soon as reasonably practicable and provide an appropriate refund or other remedy in accordance with applicable law and the circumstances of the cancellation.

If an event is postponed or materially changed, we will communicate the available options to registered participants.

4. Event Participation and Personal Responsibility

Our experiences are designed to support wellbeing, connection and personal growth in a welcoming environment.

By participating, you acknowledge that some activities, including movement sessions, outdoor experiences and other physical activities, may involve inherent risks.

You agree to participate responsibly, respect your own physical and emotional boundaries, and follow any reasonable instructions provided by our facilitators or event team.

You are responsible for assessing your own ability to participate safely and for communicating any relevant limitations or support needs to us before the event.

If you feel uncomfortable, unwell or unsafe during an activity, you should stop participating and notify the relevant facilitator.

Nothing in these Terms & Conditions excludes any duty of care or liability that cannot lawfully be excluded under New Zealand law.

5. Health and Wellness Disclaimer

ELYSIAN Experiences provides wellness-focused activities, educational content and experiences intended to support general wellbeing.

Unless expressly stated otherwise, our events, workshops and website content are provided for general informational and educational purposes only. They are not intended to constitute medical advice, diagnosis or treatment, nor are they a substitute for advice from a qualified healthcare professional.

Participation in our experiences does not establish a practitioner–patient relationship.

You should consult an appropriate healthcare professional before commencing a new exercise, nutrition or wellness programme if you have any concerns about your health or suitability for a particular activity.

You remain responsible for your own health decisions and for seeking professional advice when appropriate.

6. Dietary Requirements and Allergies

Where food or beverages are provided, we may ask participants to disclose dietary requirements, allergies or intolerances before the event.

Please provide this information within the timeframe specified in your booking communications.

While we will take reasonable steps to communicate dietary requirements to relevant suppliers and accommodate requests where reasonably practicable, we cannot guarantee that all dietary needs can be met or that food will be entirely free from allergens or cross-contamination.

If you have a severe allergy or specific medical dietary requirement, please contact us before booking to discuss whether the event is suitable for you.

7. Event Conduct

We are committed to creating inclusive, respectful and welcoming experiences.

All participants are expected to treat fellow attendees, facilitators, venue staff and our team with respect.

We reserve the right to refuse entry or ask a participant to leave an event where their behaviour is unsafe, disruptive, discriminatory, abusive or otherwise inappropriate, subject to applicable law.

Where a participant is removed due to their own serious misconduct, a refund will not ordinarily be provided, to the extent permitted by law.

8. Photography, Video and Event Content

Photography and video recording may take place at ELYSIAN events for promotional, editorial and social media purposes.

Where identifiable images or recordings of participants are to be used for promotional purposes, we will seek consent where required by applicable law and respect any applicable privacy rights.

If you do not wish to be photographed or filmed, please notify us before the event or speak to a member of our team on arrival. We will take reasonable steps to accommodate your request.

Participants must not photograph, record or publish images, videos or personal information relating to other attendees without appropriate permission.

9. Intellectual Property

All content on the ELYSIAN website and in our events, including written materials, photographs, graphics, branding, logos, workshop resources and original content, is owned by or licensed to ELYSIAN unless otherwise indicated.

You may access and use this content for your personal, non-commercial purposes.

You must not reproduce, distribute, modify, publish, sell or commercially exploit our content without our prior written permission, except where permitted by law.

10. Website Use

We aim to ensure that the information on our website is accurate and up to date. However, event details, availability, pricing and other information may occasionally change.

We reserve the right to update website content, correct errors and make reasonable changes to our services.

You agree not to use our website for any unlawful purpose, interfere with its operation, attempt unauthorised access to our systems, or misuse any information or content made available through it.

11. Third-Party Services and Venues

Our experiences may take place at third-party venues or involve independent facilitators, suppliers, catering providers or other service providers.

Where relevant, those third parties may operate under their own terms and conditions.

We take reasonable care in selecting event partners and suppliers but are not responsible for the independent acts or omissions of third parties to the extent that liability may lawfully be excluded. Nothing in this clause limits any rights or remedies you may have under applicable law.

12. Limitation of Liability

To the extent permitted by New Zealand law, ELYSIAN excludes liability for loss or damage arising from your use of our website or participation in our experiences where such loss or damage is not reasonably foreseeable or is caused by circumstances outside our reasonable control.

Nothing in these Terms & Conditions excludes, restricts or modifies any consumer guarantee, statutory right, duty or liability that cannot lawfully be excluded, restricted or modified under applicable law, including the Consumer Guarantees Act 1993 and the Fair Trading Act 1986 where applicable.

Nothing in these Terms & Conditions is intended to exclude or limit liability for negligence, personal injury, or any other liability where such exclusion or limitation would be unlawful.

13. Circumstances Beyond Our Control

Sometimes events outside our reasonable control may affect our ability to deliver an experience as planned. These may include severe weather, natural disasters, venue closures, public safety concerns, government restrictions or other unforeseen circumstances.

Where such circumstances arise, we will communicate with affected participants and take reasonable steps to reschedule, modify or cancel the event as appropriate.

Any refund or alternative arrangement will be handled in accordance with applicable law and the circumstances of the event.

14. Privacy

We collect and use personal information in connection with website enquiries, ticket bookings, event administration and communications.

We handle personal information in accordance with applicable New Zealand privacy laws, including the Privacy Act 2020.

Please refer to our Privacy Policy for further information about the personal information we collect, how we use and protect it, and how you can access or request correction of your information.

15. Changes to These Terms

We may update these Terms & Conditions from time to time to reflect changes to our services, business practices or legal obligations.

The latest version will be published on our website with the updated date.

Any changes will apply from the date they are published, subject to applicable law and any specific contractual arrangements already in place.

16. Governing Law

These Terms & Conditions are governed by the laws of New Zealand.

Any disputes arising in connection with these Terms & Conditions will be subject to the jurisdiction of the New Zealand courts, subject to any applicable statutory rights or dispute resolution requirements.
